Terms of service
These terms cover what you get when you work with us, what we commit to, what you commit to, and how either side can end the arrangement. Plain English where we can; legal where we have to.
Short version:
- You see the finished site before you pay a penny. No card during the preview stage.
- One setup fee + one monthly fee. VAT-inclusive. Cancel anytime with 30 days' notice.
- Your domain is registered in your name and stays with you if you leave.
- You own your content. We keep the rights to the underlying platform and templates.
- Governed by the laws of Northern Ireland.
1. Who we are
The Collective Software Group Ltd ("we", "us", "Thrive Studio") is a company registered in Northern Ireland, trading as thrivestudio.ai. Our registered office is in Belfast, Northern Ireland. You can reach us at hello@thrivestudio.ai or via thrivestudio.ai/contact.
2. When these terms apply
These terms apply from the moment you confirm you want to go live and we issue a setup invoice. The free preview stage (see section 3) is not a contract — you can walk away without any obligation.
By going live and paying the first invoice, you agree to these terms. If you've agreed to a separate written contract with us, that takes precedence where it conflicts.
3. The free preview
Before you pay anything we build a preview of your site based on publicly available information about your business. Specifically:
- No card, no deposit, no contract.
- The preview is hosted on preview.thrivestudio.ai and is not publicly advertised.
- You have no obligation to proceed. A simple "no thanks" is enough and we'll take it down.
- Telling us what to change does not mean you've agreed to go live. You only commit when you explicitly say yes and we issue a setup invoice.
- We may withdraw or decline to publish a preview if the underlying business is one we're not willing to work with (see section 10).
4. Going live
Once you confirm, we will:
- Ask you to pick a plan — Starter, Growth or Authority — from thrivestudio.ai/pricing.
- Set up your direct debit through Stripe.
- Collect the information we need to operate the site (business phone, opening hours, address, photos, anything you want changed from the preview).
- Register your domain in your name.
- Set up your email mailbox (where included in your plan).
- Push the site live — typically within 48 hours of you saying yes.
5. Fees and billing
- Current prices are listed at thrivestudio.ai/pricing. All prices include VAT where applicable.
- A one-off setup fee (£149 / £299 / £499 depending on plan) is invoiced when you go live.
- A monthly subscription (£29 / £59 / £129 depending on plan) is collected by direct debit on the anniversary of the setup date.
- You can pay annually instead — two months free (£290 / £590 / £1,290 respectively).
- We may adjust prices with 60 days' written notice. Price changes never apply mid-term: if you've pre-paid annually, you finish the year at the price you paid.
- If a direct debit fails, we'll retry once and contact you. Persistent non-payment (more than 14 days past due) may result in service suspension.
6. Cancellation
No lock-in. No early-exit fees. To cancel, email hello@thrivestudio.ai with 30 days' notice.
On cancellation we will:
- Stop billing at the end of the 30-day notice period.
- Transfer your domain registration to a registrar of your choice, at no charge.
- Give you an export of your site content (HTML, copy, images) within 14 days of the final billing date.
- Delete personal data held on your behalf within 30 days of cancellation, except where we're required to keep it for legal reasons (e.g. HMRC record-keeping).
We can also end the arrangement with 30 days' notice, or immediately if you materially breach these terms (e.g. non-payment, a breach of section 10).
7. Your domain
- We register your domain in your name (or your company's name) — you are the registrant from day one.
- While you are a paying client, we cover domain renewal as part of your monthly fee.
- You can request a transfer to another registrar at any time. We won't charge a fee, we won't delay it, and we won't hold on to the registrant record.
- If your domain is approaching expiry and your account is suspended for non-payment, we will let the domain lapse unless you settle the account or take over the registration yourself.
8. Intellectual property
- Content you give us (photos, logos, copy, reviews you've written) remains yours. You grant us a licence to use it for the purpose of building and running your site.
- Your site's content and brand assets — copy written about your business, photos of your business, your domain — are yours.
- The platform — template designs, framework code, the Thrive Studio brand kit, our internal tooling — remains ours. You receive a non-exclusive licence to use it as part of your site for as long as you're a paying client.
- If you cancel, you're welcome to take your content with you (section 6), but you cannot re-host the platform code or copy our templates.
- We may include a small "Built by thrivestudio.ai" credit in your site's footer. You can ask us to remove it and we will.
9. Your responsibilities
- Tell us the truth about your business — correct opening hours, real phone numbers, accurate service areas.
- Only send us photos, logos and copy you have the right to use. You indemnify us against any third-party claim that arises from content you supplied.
- Respond to customer enquiries that come through your contact form. For those enquiries, you are the data controller and we are the data processor (see privacy policy).
- Let us know promptly if anything on the site is wrong so we can fix it.
10. Acceptable use
We won't host sites that:
- Breach UK law.
- Infringe third-party rights (copyright, trademark, privacy).
- Sell regulated goods or services without the required licences (alcohol, gambling, firearms, adult content, financial services, etc.).
- Mislead customers about the nature of the business, its qualifications, or its reviews.
- Compromise the security of our platform or other clients (e.g. attempts to scrape, probe or attack our infrastructure).
We can suspend service with notice where possible, or immediately if the breach is serious.
11. Service levels and support
- Sites are served from Cloudflare's global edge. Uptime is best-effort and typically follows Cloudflare's availability — we don't offer a separate SLA or uptime guarantee.
- Planned maintenance is rare and announced at least 48 hours ahead.
- Support channels: hello@thrivestudio.ai and your client dashboard. We aim to reply within one business day (Starter), same day (Growth, Authority).
- Small content updates — opening hours, phone, photos, menu items, service tweaks — are included in your fee. Major redesigns, new pages or new features are scoped and quoted separately.
12. Limitation of liability
Our total liability to you in any rolling 12-month period is limited to the fees you paid us in that period.
We are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of anticipated savings, or loss of data beyond the export we provide on cancellation.
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited under UK law.
13. Data protection
See our privacy policy for how we handle personal data.
Where we build and run a contact form on your site, you are the data controller for those enquiries and we are the data processor acting on your instructions. A written data-processing agreement forms part of your onboarding pack.
14. Third-party services
We use the following providers to deliver the service. Their own terms apply alongside ours:
- Cloudflare — hosting, DNS, form submission.
- Stripe — payments and direct debit.
- Resend — transactional email.
- Google Workspace — client mailboxes (where included in your plan).
15. Changes to these terms
We may update these terms. Material changes will be emailed to paying clients at least 30 days before they take effect. The current version is always at thrivestudio.ai/terms with the "Last updated" date at the top of the page. If you don't agree with a change, you can cancel with no notice before the change takes effect.
16. Governing law and disputes
These terms are governed by the laws of Northern Ireland. Any dispute that we can't resolve in good faith is subject to the exclusive jurisdiction of the courts of Northern Ireland.
